EPA Issues New Comprehensive Gasoline and Diesel Penalty Policy

The U.S. Environmental Protection Agency (EPA) Office of Enforcement and Compliance Assurance has issued a comprehensive penalty policy pertaining to all gasoline and diesel fuel programs under 40 C.F.R. Part 80. The policy applies to violations of the gasoline and diesel fuel standards, as well as violations of the sampling, testing, recordkeeping and reporting provisions of the regulations.
The policy is effective February 3, 2016, but will also affect pending cases where the EPA has not yet transmitted a settlement penalty amount. It may also be applied to pending cases where negotiations have commenced. The policy can be found here on the EPA web site.
